This report analyses how 33 countries are recognizing or failing to recognize the carbon rights of Indigenous Peoples, Afro-descendant Peoples, and local communities in the lead-up to the implementation of Article 6.4 of the Paris Agreement. It aims to help governments, communities, and stakeholders assess and strengthen legal protections for carbon rights in tropical and subtropical forests, especially as global interest in Nature-based Solutions continues to grow.

The report makes the argument that the weak regulatory frameworks in Africa necessitate the development of a more “just” regulatory framework. The report defines what a just regulatory framework entails and incorporates this definition into its assessment of existing regulatory frameworks across several African jurisdictions to determine whether they embody this “just element.”
